Will and Trust Drafting: It is a priceless gift to your heirs to have planned well. Our Will and trust drafting services will enable you to manage your assets and your bequests in the event of your incapacity or death. Our passion is helping clients design their legacy.

Trust Administration: Drafting a Living Trust avoids probate court with respect to those assets that were transferred into the living trust before death. Even though no court is involved, that does not mean there is nothing to do. Our attorneys will guide you through trust administration.

Probate: Probate is the court process for collecting a deceased person’s assets, paying debts and taxes, and distributing the property to the person’s beneficiaries.

Probate takes 6-12 months and most people hire an attorney to handle the paperwork and appear in court. Without a Living Trust, probate is usually required even if you have a will. 

​​Rita A. Holder is a licensed tax attorney. She has a law degree from Golden Gate University and a post-doctorate degree in U.S. Tax Law (an LL.M)

Rita is qualified to practice before the Tax Court, the Internal Revenue Service and the California Franchise Tax Board. She has over 30 years of experience in dealing with tax agencies.

The IRS and California Franchise Tax Board have programs to help you get out from under your tax debts. For example, if you qualify for an Offer in Compromise you can pay off your taxes at a greatly reduced rate and have the liens lifted from your real property.

​​Probate Conservatorships for the Elderly​​

​If a loved one is incapacitated by illness or age, we can establish a conservatorship for you so you can manage their personal and financial affairs. A conservatorship gives you a wider range of authority than a Power of Attorney. 

​​Special Needs Trusts 

Limited Conservatorships 

Provisions for a Special Needs Trust can be included in your Estate Planning documents or added later.  A SNT is intended to protect govenment benefits (such as SSI and MediCal )  from being reduced when you gift money or property to a loved one with special needs. 
Limited Conservatorships are limited to the developmentally disabled adult and their families.  A developmental disability is one that was present before age 18 and affects intellectual capacity.

A Limited Conservatorship will give you authority to manage the health and welfare of your developmentally disabled adult child or loved one.
